Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Rallytics, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the application. These terms apply to all versions of Rallytics, including macOS and Windows.

2. Eligibility & Account

  • You must be at least 13 years old (or 16 where required by applicable law) to create an account.
  • You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
  • Accounts are for individual use. You may not share your account credentials with others.
  • You must provide accurate information when creating your account and keep it up to date.

3. Hours, Subscriptions & Billing

3.1 Hour-Based Model

Rallytics uses processing hours to measure AI analysis usage. One hour of processing time analyzes approximately one hour of submitted tennis footage.

3.2 Free Hours

New accounts receive 2 hours of processing time upon email verification, at no cost and with no credit card required. These hours expire 30 days after account creation.

3.3 Subscriptions & Auto-Renewal

Rallytics offers the following subscription plans:

  • Pro Monthly — $8.99/month. 8 hours of processing time granted at the start of each billing cycle.
  • Pro Yearly — $89.99/year. 8 hours of processing time granted per calendar month.

Auto-renewal: Subscriptions automatically renew at the end of each billing period at the then-current rate unless cancelled before the renewal date. You authorize us to charge your payment method on file for each renewal period.

Hours granted per billing cycle are valid for 30 days from the date of grant. Unused hours expire at the end of the 30-day validity window and do not carry over to the next billing cycle. You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period, and no partial refunds are provided for the remaining period.

3.4 Value Packs (One-Time Purchases)

  • Micro Pack — $4.99, 3 hours, valid for 3 months from purchase date.
  • Mega Pack — $14.99, 8 hours, valid for 6 months from purchase date.

Value Packs are one-time purchases and do not auto-renew. Hours are consumed in order of earliest expiry first.

3.5 Refund Policy

Hours consumed through AI analysis are non-refundable. Unused hours from completed or cancelled subscription periods are non-refundable. For Value Pack purchases where hours have not been used and a technical issue prevented their use, contact us within 14 days at hello@rallytics.app and we will consider a remedy on a case-by-case basis.

3.6 Price Changes

We reserve the right to change pricing at any time. We will provide at least 30 days' notice of subscription price changes via email. Continued use of a subscription after the effective date of a price change constitutes your acceptance of the new price.

4. Acceptable Use

You agree to use Rallytics only for lawful purposes. You agree to:

  • Submit only video content you own or have the legal right to analyze.
  • Use Rallytics for personal sports review, athletic training, or professional coaching purposes.
  • Comply with all applicable local, national, and international laws.

You agree not to:

  • Resell, sublicense, or commercially redistribute AI-generated analysis or outputs.
  • Attempt to reverse engineer, decompile, disassemble, or extract source code from the Rallytics application.
  • Use automated tools, bots, or scripts to access or interact with Rallytics services outside of the application.
  • Circumvent usage limits, authentication, or access controls.
  • Submit content that is illegal, contains malware, or infringes third-party rights.
  • Use Rallytics in any manner that could damage, disable, or impair our services.

5. AI-Generated Content & Accuracy

5.1 Ownership of Outputs

Rally detections, timestamps, highlight clips, and other outputs generated from your footage belong to you. Rallytics claims no ownership over your source footage or the AI-generated outputs derived from it.

5.2 Accuracy Disclaimer

AI rally detection is probabilistic and not guaranteed to be accurate or complete. Rally boundaries, shot classifications, and other AI outputs are estimates based on pattern recognition. Rallytics makes no warranty that detection results are suitable for any particular purpose, including competitive analysis, officiating, or medical or coaching decisions. Users are responsible for reviewing AI outputs before relying on them.

5.3 No Training on User Content

We do not use your video content or AI-generated outputs to train any AI or machine learning models. Video proxies submitted to Google's AI services are subject to Google's API Terms of Service, which prohibit Google from using API-submitted data to train its models.

6. Intellectual Property

Rallytics, its logo, software, visual design, and underlying technology are owned by Rallytics and protected by applicable intellectual property laws. These Terms do not grant you any ownership in or license to Rallytics's intellectual property beyond the limited right to use the application as described herein.

You retain full ownership of your source video content. By using Rallytics, you grant us a limited, non-exclusive, temporary license to process your video proxies solely for the purpose of providing the AI analysis service you have requested.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted or error-free service. We may perform maintenance, release updates, or experience outages that temporarily affect availability. Processing hours are not automatically refunded for brief or routine service interruptions. For extended outages affecting the core AI analysis feature (more than 24 consecutive hours), paid subscribers may contact us to request consideration of a remedy.

8. Account Termination

8.1 By You

You may delete your account at any time from within the application or by contacting us. Upon deletion, your personal data will be removed within 30 days in accordance with our Privacy Policy. Unused processing hours and any remaining subscription period are forfeited without refund upon voluntary account deletion.

8.2 By Us

We may suspend or permanently terminate your account if you materially violate these Terms, engage in fraudulent activity, or if required by applicable law. We will provide reasonable notice where legally required and practicable. In cases of serious violation (e.g., fraud, abuse, illegal activity), termination may be immediate without prior notice.

9. Disclaimer of Warranties

RALLYTICS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RALLYTICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 CAD.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Minor clarifications that do not materially affect your rights may be made without prior notice. Continued use of Rallytics after the effective date of any changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for the resolution of any dispute arising out of these Terms or your use of Rallytics.
